It is issued to make the citizens more responsible and encourage people to abide by the law of the country. Speeding ticket is levied on the offender to make him realize his fault. To avoid any chance of getting speeding tickets, one must obey the law at all times while driving, although this is easier said than done. When caught for speeding and given speeding tickets, having a clean driving record can help immensely in lowering or eliminating the fine.

Canada and the United States are known for their speeders and on some roads it can even are hard to find anyone that is following the traffic laws posted. If you have to speed try to match the other faster cars on the road as not to stand out to much, although you can still get pulled over, it is less likely to happen if you do stand out of the crowd. To avoid being noticed you should make sure to never be the fastest car in view and should avoid constant lane changes as these are both simple ways to get pulled over and given speeding tickets. If you get speeding tickets you should consider all your options before paying the ticket.

Having a car that looks fast can help to attract attention from police which could in turn make you get more speeding tickets. If you drive a bright yellow sports car you are going to be picked out of a crowd over someone in a silver sedan, even if you both are going the same speed. One of the main things that will draw attention to you and your car is physical damage or mechanical problems. Make sure to have any noticeable body damage fixed as soon as possible to avoid the chance of being pulled over and question about what happened, why it isn't fixed, or worse yet is your car safe to drive? Other similar problems are muffler and tire noise as well as cracked windows or bunted out turn signals. Having tinted windows will give police a reason to pull you over at any time, so if you are known to speed from time to time it is recommended you avoid tinted windows to help avoid getting any speeding tickets.

The most common place to receive speeding tickets is after a speed limit change where the speed limit drops from a high speed limit to a relatively low speed limit. Make sure to stay aware to the current speed limit and take extra note when approaching residential areas and school zones. Remember to keep in mind that as soon as you pass a speed limit sign that new speed limit applies, so you should slow to the new speed limit before passing the sign to avoid any chance of receiving speeding tickets. It is also important to note that some areas like school zones will have increased fines for speeding tickets when school is in session; this also commonly applies to construction zones as well.

Police usually find a few select spots they like to set up speed traps to issue a large amount of speeding tickets. These spots are usually located near common speeding streets, speed limit changes and places where it is hard to spot the speed trap until it is to late. In your local area you should take note of common speed trap areas and exercise caution when driving by those select areas. Knowing where speed traps are in advance is an excellent way to avoid getting any speeding tickets. If you are on a highway and notice trucks slowing down for no reason you may want to follow their lead, as many truck drivers will communicate via radio to warn other trucks of upcoming speed traps and/or roadblocks. Avoiding speed traps is a good way to not get any speeding tickets but keep in mind you can be tagged by police that are driving along the roads as well.

Proceed with extra caution at key times of the night, like closing time for local bars. Police know the times of last call and will be on extra alert for speeders and/or intoxicated drivers during these times. To avoid receiving any speeding tickets at this time of the night it is recommended you do not speed at all. There will be a heightened number of police in the area of bars and clubs and they will be even more likely to pull anyone over for any reason. Speed traps and check points are much more common at these keys times at night so to avoid any speeding tickets you must proceed very carefully.

Some drivers are known to think positively about traffic tickets, thinking if they ignore them they will simply go away. This could not be farther from the truth. If you fail to respond to your traffic tickets, you could be automatically convicted with the possibility of a warrant being put out for your arrest, which can result in you being taken into custody if and when you get caught again. You can also be subject to receiving a suspended license for failing to pay an issued fine, which is why speeding tickets should never be ignored.

Fighting a ticket on the Ohio Turnpike

If you are going to get a ticket, your best bet is on the Ohio Turnpike, as it has to follow the Federal laws and not Ohio's laws. That means the speed limit should be set to the 85 percentile speed for the limit (note it already does not follow the statutory speed limit of 65mph). That means it should be posted around 80 mph or higher. You would be best served to move to the Federal District court and then I'd tell you all of the laws to cite and show the last speed survey the state of Ohio has taken for the turnpike, plus who to subpoena...

The Federal MUTCD states you must post the speed limit at the higher of the state's statutory speed limit or the 85 percentile of speeds from a traffic and engineering survey, whichever is lower... Basically if the state of Ohio were to try and say the statutory speed limit is 65 mph and you were exceeding the posted speed limit of 70 mph, they have two defenses:

1. The 70 mph speed limit is illegal for being in excess of 65 mph, which means no valid speed limit was posted -- this would nullify the speeding infraction.
2. The 70 mph speed limit is legal because it is posted by the Ohio Turnpike Commission... your defense is this is not posted according to the US Federal regulations of the MUTCD by using the 85th percentile top speed rounded up to the nearest 5th or 10th of a mile per hour.  Surveys already exist from ODOT and the Ohio State Highway Patrol showing the 85th percentile as 80 mph for cars from 2005 (already out of date, since it is supposed to be taken every 5 years).  Please read Title 23 CFR sections supporting the MUTCD.

Either way, the speed limit as posted is invalid, unless they have a traffic and engineering safety traffic survey taken within the last 5 years showing that 70 mph is the 85th percentile speed on the Ohio Turnpike.  However, to avoid the fight, use a radar detector and your eyes to watch for the traffic cops.

Ohio Turnpike Commission Raises Speed Limit to 70 MPH effective April 1, 2011

A change is in the air, maybe the rest of the highway traffic will be allowed to go 70mph. The Ohio Turnpike Commission does not have to follow the Ohio Statutory speed limits, and should post speed limits according to the US Federal MUTCD guidelines (aka 80 MPH was the 85th percentile speed for cars, and 75mph was the 85th percentile for trucks due to last Traffic and Engineering study on the Turnpike).


If you get pulled over on the turnpike for exceeding the speed limit, I would fight the speed limit brining in the traffic and safety engineer for that ODOT district, along with Ohio State Highway Patrol's publishing of the study, and the Ohio & US MUTCD.

C.F.R. Defense (Code of Federal Regulations, Title 23, Section 603)

This defense was more applicable pre-2003 when the Federal government changed the MUTCD to add the wording "statutory speed limit".  Basically if the posted speed limit is less than the state of Ohio's statutory speed limit, you would request a dismissal if the prosecutor fails to provide a traffic engineering survey supporting the lower speed limit as stated below.

Background:  Every Community and State that accepts one cent of Federal Highway or Road funds is included. As part of the acceptance of these funds they make themselves subject to the rules and regulations contained in the C.F.R. Code of Federal Regulations. As such every police officer, when he issues a ticket is doing so under color of federal law. The collection, trial and enforcement is local in nature. The speed limit they enforce is not. (exempt are private roads)

To deal with 23 C.F.R> another Federal agency was set up called MUTCD (Manual of Uniform Traffic Control Devices). The section we are concerned with it Title 23

As to the exact wording in the C.F.R. and MUTCD, forget it. It is so complicated and requires you to know at least 200 sections plus 1,000 different legislative readings to make sense of it. Here you have to trust me. This is real. The two main case laws presented are the only two times this has gone to appeals in any State. Both interpret the law the same way. To be convicted the prosecution must show that the stretch of road you were on had the correct speed limit. To do that they have to present a document called a Traffic Engineering Survey.

What the law says is that for a speed to be enforceable it must be realistic and the fastest safe speed based on a 85 percentile. Don't bother trying to figure it out. To figure out what the speed should be a Traffic Engineering Survey is required. This survey sets the speed limit. This survey must be less then five years old for the posted speed to be enforceable.

I will be presenting cases that would support the CFR defense in future postings.  I will also be presenting my view on using the "Home Rule" defense I'm developing with cases to support it from the red light and speed cameras.  It would be another way to prove the lower posted speed limit is not legal, but using the Ohio Constitution as your authority versus the Ohio administrative code (ORC) in conjunction with the Federal administrative code (CFR).
